Nigerian Constitution (Nigerian Union Hungary)



THE CONSTITUTION OF THE  NIGERIAN UNION HUNGARY   



PREAMBLE 
We the citizens of the Federal Republic of Nigeria resident in the Republic of Hungary have firmly and solemnly resolved to live and work in unity and harmony as one indivisible Union, dedicated to the promotion of co-operation, understanding and of solidarity amongst Nigerians and provide for a constitution for the purpose of promoting a healthy Union, human rights, integration and welfare of all members in the principles of freedom, equality, justice, democracy and cordial relationship between the Union and the host country Hungary. We do hereby make, enact and uphold this constitution   
                                                     
ARTICLE 1 
The Union shall be known and referred to as ' THE NIGERIAN UNION, HUNGARY'. 
It shall operate as an apolitical and non-profit association. 
Its Motto shall be UNITY AND PROGRESS.  
                                             
ARTICLE 2 
GENERAL PROVISION 
A. This constitution shall not be governed; neither shall any person nor group of persons take control of the administration of the Union or any part thereof, except in accordance with the provision of the constitution. 

B. This constitution shall be supreme and its provisions shall have a binding force on all members of the Union.                                                                      

ARTICLE 3 
OBJECTIVES 
A. To bring all the members together, to live and work in unity and harmony as one indivisible Union, dedicated to the promotion of co-operation, of understanding and of solidarity amongst the members. 

B. To act as a forum for bringing economic, educational and social awareness amongst members and for looking into matters affecting the members within the limit of the Union 

C. To promote social and cultural identity through the organisation of various uplifting cultural programs. 

D. To integrate members into the Hungarian society 

E. To develop and propagate the rich Nigerian cultural heritage 

F. To engage in charity within the limit of the Union  

G. To maintain, promote and develop a strong, independent, democratic, powerful and effective  Nigerian union: nationally and internationally 

H. To keep a good relationship with other Nigerian associations and organizations in Hungary, Nigeria and so on 

I. To strengthen the power and influence of the Nigerian union both nationally and internationally 

J. To develop resources means to promote economic, social and cultural progress of the Union  

K. To assist members and their family morally and financially within the available resources of the Union in case of any natural disaster or unforeseen circumstances 


ARTICLE 4  
MEMBERSHIP AND OBLIGATIONS 
Membership shall be open to all Nigerians upon registration. 
A person is regarded a Nigerian by: 
4/1  

A. Birth  

B. Naturalization  

4/2.  

Membership shall be open to other citizens that are married to Nigerians. However, such members shall not be eligible to contest for elected positions nor shall have the right to vote in the elections.  

4/3 Every member shall be obliged to:  

I. Pay his/her registration fees. 

II. Pay his/her monthly dues as may be agreed by the House.  

III. Work with the other members of the Union in accordance with the Constitution for the          realization of the aims and objectives of the Union. 

IV. Attend meetings and programs regularly. 

V. Abide by the codes of conduct of the Union.  

RIGHTS OF MEMBERS 

A. Freedom of expression shall be guaranteed 

B. Voting rights for members above 18 years of age 

C. Active members may receive the support of the Union as agreed by the House  

HONORARY AWARD 
Honorary certificate(s) may be awarded to an individual or organisation based on their contribution towards the growth and development of the Union  
                                                           
ARTICLE 5  
MEETINGS 

A. The general meeting shall be held on the first Sunday of every quarterly between the hours of 3.00 – 6.00 pm or at any other time as may be agreed by the House 

B. Meeting dates may be altered if the security of members is threatened or when the executive decides otherwise 

C. Emergency meetings shall be called by the president whenever it is necessary 

D. A member of the Union could propose to the president that an emergency meeting be held whenever the need arises stating the reasons. The Executive may decide on the meeting upon appraisal of the reason enumerated. 

E. A meeting shall require a quorum of 20% of members who have paid their dues at the time  

F. A meeting shall require a quorum of 50% plus one vote of the House to make decisions  

G. In case of the absence of a quorum for decisions, the executive shall decide when the new meeting shall be reconvened  

H. The executive meetings shall be held when necessary; and this decision shall be the sole responsibility of the Executive                                                                                       

ARTICLE 6  
OFFICES  

All offices may be held by any registered member of the Union The following offices shall constitute the Executive members of the Nigerian Union:  

A. The office of the President 

B. The office of the Vice President 

C. The office of the Secretary General 

D. The office of the Financial Secretary

E. The office of the  Treasurer 

F. The office of the Provost 

G. The office of the Social and Cultural Officer 

H. The office of the Public Relations Officers 1,2,3 and 4  

The office of the Public Relations Officer 1 shall be held by a member that is resident in Budapest. The office of the Public Relations Officers 2, 3 and 4 shall be held by members resident in three different cities in Hungary with the highest population of Nigerians  
                                                    
ARTICLE 7  
JOB DESCRIPTION  

(A) The President  
(i)  The Union shall be headed by the President who presides over the executive, general and   emergency meetings 

(ii)  The President shall convene emergency meetings whenever it is necessary. 

(iii)  Shall be signatory to all documents and publications 

(iv)  Shall be a moderating influence on all other offices 

(vi)  Shall appoint members of ad-hoc committee for special duties when necessary  

(vii)  May recommend a member for suspension if the conduct of the member amounts to violent disruption of meetings, acts or conducts inimical to the existence of the Union. Such suspension shall be upon the approval of two/third of the House.  

(B) Vice President  
(i) Shall assist the President 

(ii) Shall assume the responsibilities of the President in his absence 

(iii) Shall assist in coordinating the duties of all other executive members 

(iv) Shall see to the orderly arrangement of the activities of the Union 
  
(C) The Secretary General  
(i) The Secretary General shall be responsible for recording and reading minutes of all meetings 

(ii) Shall maintain and update all social media of the Union 

(iii) Shall keep records of incoming and out-going correspondences 

(iv) Shall be a signatory to all official documents related to his office 

(v) Shall be a signatory to the Union's bank account  

(D) The Financial Secretary   
(i) Shall keep, update and maintain accurate financial accounts of the Union  

(ii) Shall have all copies of financial transactions kept by the treasurer    

(iii) Shall collect the revenues of the Union  

(E) Treasurer   

(i) Shall be empowered to solicit for funds for the successful running of the Union 

(ii) Shall be a signatory to all the financial documents of the Union 

(iii) Shall keep the Union’s fund in any Bank approved by the Union  

(F) Provost 
(i)   Shall arrange for the procurement of venues for meetings 

(ii)  Shall see to the orderly conduct of members during meetings 

(iii)  Shall collect all fines from defaulting members which shall be handed over to the Financial Secretary   

(G)   The Social and Cultural officer  
(i) Shall organize all social and cultural programs of the Union 

(ii) Shall liaise with other existing cultural entities in and outside Hungary with a view to promoting Nigerian cultural heritage  

(H)  The Public Relations officers              
(i) Shall liaise with internal and external bodies in order to disseminate information and promote the ideals of the Union. 

(ii) The PRO (1) shall co-ordinate the PROs in other cities 

(iii) The PROs  shall assist the Financial Secretary to solicit for funds for the successful running of the Union                               

ARTICLE 8 
TERMS OF OFFICE 

(a) The elected officers shall serve for one term - of two years 

(b) Outgoing officer/officers may be re-elected for another two years 

(c) Upon the conclusion of  two terms (4 years in total), outgoing officer (s) shall not be eligible to run for the same position.  

(d) Officers may contest for other positions after serving one or two terms in a particular position 

(e) All officers must have attained a minimum age of eighteen years.    
                                                                 
ARTICLE 9 
FINANCE  
(a) There shall be a registration fee of 2,000 Forint or any other amount as may be agreed by the House 

(b) There shall be a fee of 1,000 Forint by all registered members at every general meeting or as may be agreed by the House 

(c) Upon the approval by the house, there shall be a special levy on members in case of unforeseen circumstances affecting the Union or any member 

(d) There shall be joint signatory right for the President, Financial Secretary and the Treasurer 

(e) 
(i) The Financial account of the Union shall be audited once in a year by an ad-hoc financial committee initiated by the President and appointed by the House  

(ii) The report of the committee shall be submitted to the executive body who will in turn, present it to the members at the general meeting for acceptance. 

(iii) The month of January shall be the beginning of every financial year                                                               
ARTICLE 10  
ELECTIONS  
A.  
(i) Shall be conducted by secret ballot  

(ii) Election into offices shall be in agreement with article 6 

(iii) Each member shall be entitled to one vote for each of the offices

(iv) The electoral committee shall ensure a mechanism to ascertain that voters register is prepared prior to the voting exercise on the election day and that only the members that are registered for voting are allowed to cast their votes.

(v) Only members that have satisfied their financial commitments to the Union as stipulated in Article 4/3 sections (i) and (ii) shall be eligible to cast a vote and be voted for during the election. 

(vi)  All aspiring officers shall jointly contest for the positions on the same date and venue   

B. QUALIFICATION FOR ELECTION  
(i) Any person seeking an elective position within the Union must be a registered member of the Union. In a situation where the activities of the Union are not effective for over six months, all Nigerians are deemed eligible to contest for elective positions in order to reactivate the Union. 

(ii) Must have fulfilled all financial obligations to the Union 

(iii) Must have a resident permit in Hungary. 

(iv) Aspiring candidates shall provide to the electoral committee amongst other documents, an original clean criminal record issued by the Hungarian authorities with validity not later than three months prior to the election date 

(v) Any Nigerian found to have engaged in fraud or any kind of manipulation within the activity of the Union in the past or present may be banned from contesting for the executive office 

(vi)  Application forms for the position of President and Vice President shall attract a fee of Five thousand Forint while other positions shall attract Two thousand five hundred Forint.

2. Vice President  
1. Must have lived in Hungary for a minimum period of five years 

2. Must have a knowledge of English and Hungarian language 

3. Must have obtained a minimum of SSCE/WAEC certificate or its equivalent 

4. Must be legally resident in Hungary with a possession of a minimum of two years resident      permit or Hungarian citizenship 5.  May be resident anywhere in Hungary   

3. General Secretary  
1. Must have lived in Hungary for a minimum period of two years 

2. Must have a knowledge of English and Hungarian language 

3. Must have obtained a minimum of SSCE/WAEC certificate or its equivalent 

4. Must be legally resident in Hungary with a possession of a minimum of two years resident permit or Hungarian citizenship  

5. May be resident anywhere in Hungary  

4. Financial Secretary  
1. Must have lived in Hungary for a minimum period of one year 

2. Must have obtained a minimum of SSCE/WAEC certificate or its equivalent 

3. Must be legally resident with a possession of a minimum of one year renewable resident permit or Hungarian citizenship 4. May be resident any where in Hungary 

5. Treasurer  
1. Must have lived in Hungary for a minimum period of one year 

2. Must have obtained a minimum of SSCE/WAEC certificate or its equivalent 

3. Must be legally resident with a possession of a minimum of one year renewable resident permit or Hungarian citizenship  

4. May be resident any where in Hungary  
  
6   Provost  
1. Must have lived in Hungary for a minimum period of one year 

2. Must have obtained a minimum of SSCE/WAEC certificate or its equivalent 

3. Must be legally resident with a possession of a minimum of one year renewable resident permit or Hungarian citizenship 

4. May be resident anywhere in Hungary   

7. Social and Cultural Officer  
1. Must have lived in Hungary for a minimum period of two years 

2. Must have a basic knowledge of English and Hungarian language 

3. Must have obtained a minimum of SSCE/WAEC certificate or its equivalent 

4. Must be legally resident with a possession of a minimum of two years resident permit or Hungarian citizenship 

5. May be resident anywhere in Hungary  

8. Public Relations Officers 1  
1. Must have lived in Hungary for a minimum period of two years 

2. Must have a basic knowledge of English and Hungarian language 

3. Must have obtained a minimum of SSCE/WAEC certificate or its equivalent 

4. Must be legally resident with a possession of a minimum of two years resident permit or Hungarian citizenship 5. Must be resident anywhere in Hungary  

9. Public Relations Officers 2, 3 & 4  
1. Must have lived in Hungary for a minimum period of one year 

2. Must have a basic knowledge of English and Hungarian language 

3. Must have obtained a minimum of SSCE/WAEC certificate or its equivalent 

4. Must be legally resident with a possession of a minimum of one year renewable resident permit or Hungarian citizenship 5. Must be resident in any three different cities outside Budapest  

C. ELECTION PROCEDURES  
1. All election procedures shall be guided and directed by the ad-hoc electoral committee appointed by the House 

2. Members may nominate a candidate to be voted for, or a candidate may nominate him/herself. 

3. Candidates shall collect and fill application forms. This shall be submitted with all the necessary documents and a passport photograph within the deadline set by the electoral committee. Applications submitted after the set deadline shall not be accepted. False data filled into the application forms shall lead to the disqualification of the aspirant. 

4. A candidate must secure 50% of the eligible voters even if nominated or elected unopposed  

5. In a situation where a particular position is not occupied, the President shall appoint a member of the House to fill that position for a maximum period of three months 

6. On Election Day, candidates shall present their manifesto to the general House for a maximum of ten minutes.

7. Two members of the House shall each be allowed to ask each candidate a question in respect to the presentation made and, or to reveal the credibility of the candidate. 

8. A simple majority vote shall determine the winner of the elections 

9. Queries about electoral irregularities shall be publicly tendered to and addressed by the electoral committee on the same day of the election before the final declaration of the results.  

10. Member of the Union that has attained a minimum age of eighteen years shall be eligible to contest for elective position and/or cast votes. 

11. In order to avoid conflict of interest, Nigerians who are members of staff at the Nigerian embassy could participate in all activities of the Union but shall be ineligible to contest for any position in the executive body of the Union. 

12. If a position is vacant during tenure due to resignation or other reasons, the Executive shall call for a by-election to fill in the vacant position  

D. GUIDELINES FOR THE ELECTORAL COMMITTEE  
(i)  The committee shall be inaugurated three months before the expiration of any tenure of the executive 

(ii) Shall set the date and venue for the election 

(iii) Shall make application forms available to the candidates and publicise the elections from the finances of the Union 

(iv) Shall screen applicants as well as the rights to disqualify candidates that do not satisfy the requirements of this constitution. 

(v) Produce ballot papers and all materials required for the elections from the finances of the Union which shall be provided by the outgoing executive of the Union. 

(vi) Shall organise the manifesto, conduct the elections, count votes and announce the results publicly. (vii) Election results declared by the electoral committee shall be final. However, aggrieved individuals may submit their petitions within two days to the electoral chairman who with other appointed Nigerians would deliberate as a matter of urgency to proffer solution   
                                                          
ARTICLE 11  
THE HOUSE  
1. The House is hereby referred to as members present at a particular general meeting.  

2. It shall exercise the necessary legislative powers  

3. Shall impeach any officer in cases of misconduct, mismanagement, corruption, inefficiency and sabotage. 

4. Shall elect committees such as constitution reviewing, electoral, investigative and any of such committee that may be necessary for the smooth operation of the Union. 

5. Indicted officers shall be impeached by a two-third (2/3) majority of the eligible voters based on the conclusions of the investigative committee. 

6. Shall pass a vote of no confidence on the entire executive if no visible achievement or activities are recorded by the Union within six consecutive months                                                               


ARTICLE 12   
CODES OF CONDUCT  
(a)  The affairs of the Union shall be conducted in English Language      

(b)  Apart from members of the executive, no member shall address the house prior to    permission from the President or the General Secretary      

(c)  All members shall be expected to show a high level of discipline and decorum during meetings   

(d) Every member of the Union shall have the right to air his/her views appropriately       

(e) Members must show mutual respect for each other. No member shall exhibit rude and indecent behaviour towards another.         

(f) A fine of 5,000 Forint shall be imposed on an erring member. Failure to pay such fine shall lead to the withdrawal of the membership of such a member.       

(g) No one shall speak to interrupt when another is addressing the House. Point of correction or order shall be allowed only after the speaker has concluded his/her speech. A maximum of five minutes is allowed for members to speak at a particular time.       

(h) Parents attending general meetings with their children shall ensure that such children do not disrupt the proceedings of the House.        

(i) Disputes between members shall be amicably settled by the executive and selected members of the Union        

(j) Non- Nigerians are not allowed into the venue of our general meetings unless invited by the executive for a special purpose. Such persons shall be introduced to the House before the commencement of the meeting        

(k) The Union shall not support any discreditable conduct or illegal activities capable of damaging the image of Nigeria or that of the Union        

(l) Formal salutations like: Mr President, members of the executive, ladies and gentlemen, shall be observed by members before making addresses on the floor of the House.        

(m) Members are expected to contribute voluntarily to help the Union financially or materially.                                                                 
ARTICLE 13  
DISSOLUTION OF THE ELECTORAL COMMITTEE  
The electoral committee shall be dissolved one week after the elected executives have resumed office.  
                                                        
 ARTICLE 14  
The House shall, based on the recommendation of the President and acceptance by the house appoint an ADVISORY Committee of elders consisting of three people to assist in resolving Union disputes not regulated by the Constitution. Such body shall only have an advisory role and cannot overrule any decision taken by the House. 

Members shall consist of Nigerians with high reputation within the Nigerian Community and shall also be obliged to provide to the executive before the appointment, an original clean criminal record issued by the Hungarian authorities with validity not later than three months prior to the appointment date. 

The House shall have the right, with a majority vote, to dissolve the Advisory Committee at any time. 

The term of office for the Advisory Committee shall expire on the expiration of the term of office for the elected posts.    
                                                           
ARTICLE 15  
EFFECTIVENESS OF THE CONSTITUTION  
1. The constitution shall come into effect as soon as the House adopts the resolution which declares this constitution valid. 

2. The Constitution shall be adopted in a General House meeting.  

3. The Constitution shall become effective by the approval of two-thirds majority.      

ARTICLE 16   
TRANSLATION OF THE CONSTITUTION  
In case of conflicts in meaning between different language editions or interpretations as a result of the translation of this Constitution, the English text shall prevail and supported by 2/3 affirmation by members.  
                                                        
ARTICLE 17  
REVIEW OF CONSTITUTION  
(a)  The constitution shall be reviewed at the end of tenure unless otherwise suggested by the House 

(b)  Final amendment shall be by two-third majority vote of the House in a General meeting.    

ARTICLE 18  
ADOPTION  
All stipulations herein stated are binding on all members and remain a sacrosanct document of the Union as amended and adopted this day.............................. 2015    

Addendum: Payments as required in Article 4/3 (i and ii) shall be acceptable at the venue and the date of the first election. The addendum shall become null and void immediately after the swearing in of the newly elected executive body.

Lionel Messi aka King of football sentenced to 1 year and 9 months in jail

After a long time of embarrassment, the FC Barcelona and world star Lionel Messi and his dad, Jorge were sentenced to 21 months in prison for tax evasion .









They were found guilty of three counts of tax evasion, fined 3.2 million Euro (Messi 1.7 million euro and his dad 1.5 million euro ) and sentenced to 1 year and 9 months with a chance of appellation (in Wendy Williams' voice :) ).






Do not panic Barca fans, the Spanish law have got you covered. There is a 99.9% chance that Messi and his Dad would choose to go on probation over jail time because the Spanish law states that a sentence less than two year could be served on probation.

Finally! Oscar Pistorius goes to jail

Oscar Pistorius has been sentenced to 6 years for the murder of his girlfriend, Reeva Steenkamp in 2013.





He is eligible for parole after serving half of his jail time, but given that he has already served one year, he has two more to go before he will be up for parole. Parole is usually granted on good behaviour, let's hope he conducts himself very well and of course, that the Steenkamp doesn't set him up (maybe i watch too many jail movies...).

For those who are unfamiliar with Metropol, the newspaper was shared free of charge in metro stations and some tram stops in Budapest.

VICTORY FOR HUNGARY IN EURO 2016

Congrats to the Hungarian team and Hungary for beating Austria 2 nil yesterday, leaving Hungary at the top of the Group F's table with 3 points.




Kudos to  Adam Szalai and Zoltan Stieber for giving us the first and the second goals, respectively. Not to forget the men behind the goals; a big thank you to Laszlo Klienheisler and Tamas Priskin for those assists and to the rest of the team for team effort.

UBER BANNED IN HUNGARY BY THE NATIONAL ASSEMBLY




On June 13, 2016,  the National Assembly of Hungary gave the authorities the power to block sites that render unauthorized livery services”.
The bill was passed by Miklós Seszták, the Minister of National Development and have been approved by MPs with  119 to 61 votes, and three absentees. The law is set to be effective from July 2016.

The transportation authority now has the power to temporarily shutdown websites and apps that render or promote services that are deemed by the transportation authority to be going against the law or does not not meet the legal requirements as defined by government regulations. For instance, Uber and Airbnb.

The access to an offending provider can be restricted for up to 365 days, with an automatic ban lift after the restriction period. And as you must have guessed, the telecommunications providers were not left out, they will be monitored. Any telecom providers who do not follow this law, could be fined from HUF 50,000 (USD 185) to HUF 200,000 (USD 740).
The body in charge of the supervisions and restrictions is the National Media and News Broadcast Authority.

A FILMMAKER STRONGLY BELIEVES BEYONCE STOLE FROM HIM

Oh dear! I wonder what's wrong with Beyonce's team?! She's always being accused of stealing one thing or the other, from outfits down to trailer ideas. Mathew, a filmmaker claims Beyonce stole Lemonade trailer from video. I'm afraid it might be true. I screenshot the evidence from Wendy Williams show.
